Specifically, GIGAS is committed to the obligation of keeping secret the information to which it has access and to take the necessary security measures to prevent access, modification or deletion of information in an unauthorized manner.

Who is responsible for your personal data?

GIGAS, whose registered office is on Avenida de Fuencarral 44, Edificio 1, 28108 Alcobendas and whose tax identity number (CIF) is A-86125218, is responsible for the processing of data relating to the different processes regarding the management of personal data provided by users, clients, potential clients, partners, suppliers or any other person who requests information and who provides personal data.

Furthermore, we would like to inform you that regarding the processing of data on information management referred to in this section, there are no entities jointly responsible for its processing.

What type of data do we have about you and how did we obtain them?

The kind of personal data that Ignitar processes with regard to interested parties mentioned in section 1 are:

• Identification information
• Postal and/or electronic addresses
• Financial and transaction information
• Professional information
• Marketing information
• Personal circumstances

In no case do we process specially protected data. All of the above-mentioned information is either obtained directly from you via a form, or request for information, or by your company when they provided us with identification information and other information necessary to carry out a relationship with GIGAS or because data was requested. It is your obligation, or that of your company, to provide us with updated data in the event of any modification. With regard to data of possible employees, these were obtained when they submitted their CV, or their application was obtained via the services of an employment portal. In the case of the latter, by sending us your CV information you have authorized us to transmit said data to our company.

GIGAS would like to inform its clients that the information it hosts on the company’s cloud servers can only be accessed by the clients themselves and never by GIGAS. Servers and access policies are managed by the client, and GIGAS does not have access unless specifically given permission by a client who allows us to be a temporary user by setting up access in accordance with their firewall’s rules. It is the client’s responsibility to remove said user or to regenerate the access credentials.

Regarding the information hosted on our company’s servers, GIGAS can in no case whatsoever encrypt or pseudonymize the information, or prevent, in any other way, a client from accessing the information and hosting it in the way they wish within our infrastructure.

How long do we keep your data?

The personal data of the interested parties referred to in section 1, and collected by GIGAS through the various contact and/or information collection forms, will be retained for as long as the holder of the data does not exercise his/her right of deletion. The information provided will be retained for as long as the business or commercial relationship between the parties is maintained, and legal minimum periods of retainment will be respected in accordance with the type of information involved.

Thus, GIGAS will retain your personal data for as long as is reasonably necessary, taking into account any need to deal with matters or to resolve problems, make improvements, activate new services, and comply with the requirements of applicable legislation. This means that we may retain your personal information for a reasonable period of time even after you no longer use our products or you stop using this website. After this period, your personal data will be deleted from all of GIGAS’ systems.

What is the purpose of processing your information, and on what lawful basis is it done?

At GIGAS we process the information provided by interested parties in order to manage the various activities that stem from the provision of the service itself, from possible marketing actions, from requests for information, etc. We therefore use your information to carry out some of the following actions based on the appropriate lawful basis:

To which third parties may your data be transmitted?

We would like to inform you that we may provide your personal data to Public Administration bodies and competent Authorities should GIGAS receive a legal request from said Authorities or in cases where, acting in good faith, we consider such action to be reasonably necessary to comply with a legal process; to respond to any complaint or legal claim; or to protect GIGAS’ rights or those of its clients and the general public.

GIGAS may provide your personal data to third parties (e.g. internet service providers who help us run our website or that carry out contracted services, as well as technical computer support and maintenance companies, logistics companies, tax advisers, accounting and tax consultants, etc.). Third parties must, at all times, maintain the same levels of security as GIGAS with regard to your personal data and, when necessary, are bound by legal obligations to keep your personal data private and secure, and may only use the information following specific instructions issued by GIGAS.

We would like to inform you that our company does not carry out international transmission of data regarding information management related to the groups mentioned in section 1.

What rights do you have as an affected or interested party?

Everyone has the right to obtain confirmation as to whether or not GIGAS is processing their personal data.

Specifically, interested parties may request the right to access their personal data, as well as to receive them in a commonly used or machine-readable format if the processing is carried out by electronic means (right to data portability).

We would also like to inform you that you have the right to withdraw, at any time, the consent you granted without it affecting the legality of the processing based on your consent prior to its withdrawal. Furthermore, you have the right to file a complaint with the Spanish Data Protection Agency, in particular if you have not been able to exercise your rights satisfactorily.

SECURITY

When you start completing a purchase for GIGAS products or log into your personal account you can do so through a secure server. Furthermore, all payment information is entered through a secure connection between your browser and the servers that process the payment. The use of Secure Socket Layer (SSL) technology means that all personal information, such as your credit card number, will be encrypted and transmitted in a completely secure manner as it travels across the Internet.

If your browser supports SSL (all modern browsers do), and if you entered our site via our secure server access, then transmission of any sensitive data will be protected. If your browser does not support SSL, we recommend that you upgrade to the latest version of any browser to enhance the security of further transactions, otherwise the transmission of your personal data may not be protected and GIGAS disclaims any responsibility in this regard.

When you place an order, you become a Registered User. This will save you time when you place other orders in the future – as long as you have filled in your personal details in the purchase area. You can also login to check and modify your personal details, control and manage your products and see and print your bills as well as your order history and status. We may also send Registered Users product information and special offers that we believe may be of interest to them, as well as occasional newsletters. Registered Users can unsubscribe from this service at any time.

Registered users will be asked to provide a Password to log into the gigas.com website. The password will be stored encrypted in our servers and GIGAS personnel will not have access to these passwords in plain text. Should you lose or forget your password we will not be able to retrieve it for you, although we will be able to reset it with a new one. The registered user should keep this password secret and will be responsible for the misuse or communication of this password to other persons. GIGAS will not be held responsible for any access derived of a misuse of the password.

You declare that all personal data provided to us is true and correct at the time and that any changes will be communicated or updated directly in your account area of our website. As long as you have not refused to receive such information electronically, we use your personal information to identify you as a customer, to process your orders and to send you relevant information regarding your purchases and orders.
